An Act Respecting Highway Safety
His Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
Motor Vehicle Act
1( 1) Subsection 54(2) of the Motor Vehicle Act, chapter M-17 of the Revised Statutes, 1973, is repealed and the following is substituted:
54( 2) An application for a dealer’s, sub-dealer’s, used motor vehicle dealer’s or wrecker’s licence shall be made on a form provided by the Registrar and shall be accompanied by
(a)  a letter dated no earlier than six months before the date of application and signed by an appropriate official of the local authority where the proposed business for which the application for a licence is made is or will be situated, stating that it is in conformity with the planning and zoning requirements as provided for in any plans adopted by by-law or in any by-laws or regulations made under the Community Planning Act,
(b)  the security bond required under subsection (3), dated no earlier than six months before the date of application, and
(c)  the fee prescribed by regulation.
1( 2) Section 95 of the Act is amended
(a)  by repealing subsection (3) and substituting the following:
95( 3) Every licence is renewable on its expiration, upon application and payment of the required fee, but the Registrar may, in the Registrar’s discretion subject to subsection (3.1), require an applicant to submit to an examination under section 89.
(b)  by adding after subsection (3) the following:
95( 3.1) When a licence has expired for a period of more than five years, the Registrar shall require an applicant to submit to an examination under section 89.
1( 3) Subsection 130(1) of the Act is amended by striking out “one thousand dollars” and substituting “$2,000”.
1( 4) Section 140 of the Act is amended
(a)  in subsection (1.1)
( i) in paragraph (a) by striking out “twenty-five kilometres per hour” and substituting “25 km/h”;
( ii) by repealing paragraph (b) and substituting the following:
(b)  by driving at a speed of more than 25 km/h but not more than 50 km/h in excess of a speed limit referred to in that subsection commits an offence,
( iii) by repealing paragraph (c) and substituting the following:
(c)  by driving at a speed of more than 50 km/h but not more than 80 km/h in excess of a speed limit referred to in that subsection commits an offence, or
( iv) by adding after paragraph (c) the following:
(d)  by driving at a speed of more than 80 km/h in excess of a speed limit referred to in that subsection commits an offence.
(b)  by adding after subsection (1.2) the following:
140( 1.3) Despite section 51 or subsection 56(8) of the Provincial Offences Procedure Act, if a person is convicted of an offence under paragraph (1.1)(d), the minimum fine shall be double the minimum fine specified in the Provincial Offences Procedure Act for that category of offence.
140( 1.4) If a peace officer is satisfied that there are reasonable grounds to believe an alleged violator under paragraph (1.1)(c) or (d) has committed an offence, the peace officer shall detain the motor vehicle involved and the vehicle shall be impounded
(a)  with respect to an offence under paragraph (1.1)(c), for seven days from the time it was detained, or
(b)  with respect to an offence under paragraph (1.1)(d), for 30 days from the time it was detained.
140( 1.5) Section 310.2 applies to the detention and impoundment of a motor vehicle under subsection (1.4).
1( 5) Section 158 of the Act is repealed and the following is substituted:
158( 1) Despite section 1, in this section, “service vehicle” means a tow truck, a private or public utility corporation vehicle and a road safety or maintenance vehicle under contract with the Province.
158( 2) Where a highway is divided into two roadways by an intervening space or a physical barrier or clearly indicated dividing section constructed so that it impedes vehicular traffic, no driver shall drive a vehicle over, across or within the intervening space, barrier or dividing section, except at a cross-over or intersection clearly marked as such by a traffic control device.
158( 3) Only an authorized emergency vehicle or service vehicle shall be considered an authorized vehicle for the purposes of a traffic control device under subsection (2) that indicates that only authorized vehicles may use a cross-over.
1( 6) Subsection 297(2) of the Act is amended
(a)  in paragraph (a) by striking out “5 points” and substituting “6 points”;
(b)  by adding after paragraph (g) the following:
(g.001)  upon conviction of an offence under paragraph 140(1.1)(d), 6 points;
1( 7) Subsection 310.0001(1) of the Act is amended
(a)  in paragraph (a) of the English version by striking out “or” at the end of the paragraph;
(b)  in paragraph (b) by striking out the period at the end of the paragraph and substituting “, or”;
(c)  by adding after paragraph (b) the following:
(c)  any peace officer designated by the Minister under subsection 15(1) for the purposes of this Act.
1( 8) Section 310.2 of the Act is amended
(a)  in subsection (1) in the portion preceding paragraph (a) by adding 140(1.4),” before “310.01(11) or (12)”;
(b)  in subsection (22) by adding 140(1.4),” before “310.01(11) or (12)”;
(c)  in subsection (23) by adding 140(1.4),” before “310.01(11) or (12)”.
1( 9) Schedule A of the Act is repealed and the attached Schedule A is substituted.
Off-Road Vehicle Act
2 The Off-Road Vehicle Act, chapter O-1.5 of the Acts of New Brunswick, 1985, is amended by adding after section 24.02 the following:
Sale of impounded vehicle
24.03( 1) Despite section 24.02, when within seven days after an off-road vehicle has been impounded under this Act, no person notifies the Registrar they are the registered owner of the vehicle, and the Registrar ascertains that the vehicle has a market value not exceeding $1,000, the Registrar may, with the authorization of the Minister and subject to subsection (2), dispose of the vehicle as the Registrar sees fit, including selling it for the best price possible in the circumstances.
24.03( 2) Before disposing of an off-road vehicle under subsection (1), the Registrar shall give notice in The Royal Gazette specifying the name of the registered owner, a short description of the vehicle and the date after which it is proposed to dispose of the vehicle.
24.03( 3) The Minister shall apply the proceeds of a sale, if applicable, in payment of the costs and charges of storage and the fine, damages to property or persons, if any, and the costs of advertising and sale.
24.03( 4) If any person other than the registered owner claims to be the owner of the off-road vehicle or to have an interest in it by reason of a lien or otherwise, the Minister, upon being notified of the claim or claims, shall pay over the balance of the proceeds of the sale, subject to subsection (3), to the Registrar of The Court of King’s Bench of New Brunswick, to be disposed of as a judge of the Court may by order direct.
Regulations under the Motor Vehicle Act
3( 1) Form 1 of New Brunswick Regulation 88-6 under the Motor Vehicle Act is amended by striking out “two hundred fifty dollars ($250)” and “ten thousand dollars ($10,000)” and substituting “$500” and “$20,500”, respectively.
3( 2) Section 5 of New Brunswick Regulation 2007-39 under the Motor Vehicle Act is amended
(a)  in paragraph (a) of the English version by striking out “and” at the end of the paragraph;
(b)  in paragraph (b) by striking out the period at the end of the paragraph and substituting a semicolon;
(c)  by adding after paragraph (b) the following:
(c)  a school bus; and
(d)  a private or public utility corporation vehicle that is being used for emergency repairs.
